A Lasting Power of Attorney (LPA) is a document that allows you (the donor) to appoint one or people (attorney’s) to help you make decisions or make decisions on your behalf. This gives you more control over what happens to you if you have an accident or illness and cannot make your own decisions. It ensures that you have people that you trust to act on your behalf rather than a stranger or perhaps someone you do not trust.
There are two types of LPAs:
- Health and Welfare
- Property and Financial Affairs
It is normally suggested that individuals set up both types of LPAs.
At Quilter Cheviot, we require the Property and Financial Affairs version. We will only add this to your account when the LPA is invoked/validated. We will require a form to be completed along with a copy of the validated LPA to add the POAs to your account. The form can be obtained from Investment Manager or Financial Planner.

The COP make decisions on financial, or welfare matters for people who cannot make decisions at the time they need to be made (they “lack mental capacity”). A Deputy is appointed by the Court to makes these decisions.

We understand that you may want to add a trusted person (third party) to your account to support you in your discussions and interactions with us (you do not require a Lasting Power of Attorney to do this). By adding the person to your account, they will have the following authority:
- Give investment (or other) instructions on your behalf including instructions relating to the transfer of any cast from your account to a bank account in your name.
- Do all such things generally relating to your account as they may reasonably consider appropriate.
- Execute or sign all contracts, receipts, acknowledgements, notices, instruments or other documents necessary or desirable for causing to be done any of the acts or things listed above.
- Granting access to view your account and all information related to it (including portfolio valuations), via our client portal and mobile application.
By giving a trusted person authority to your account , it does not remove the requirement for us to continue to liaise with you and we will ensure we interact with the third party in the manner you have stipulated to us.
